국문 초록 이스라엘 공동체에서의 도피성 제도는 과실치사의 범죄를 범한 자에게 속죄의 기회를 부여하는 종교적 기능의 성격도 존재하였지만 인간의 생명권 보호라는 인권보장 기능과 사회정의 실현을 위한 형사사법시스템으로서의 기능을 아울러 수행한 제도로서 궁극적으로는 인간의 존엄과 가치 보호라는 목적을 위해 운영된 사회시스템이라고 할 수 있다. 이 도피성 제도에 대한 고찰을 통해 오늘날 우리 헌법이 규정하고 있는 몇 가지 유형의 기본권 보장에 관련된 법리들을 발견할 수 있다. 즉, 인간의 존엄과 가치 및 행복추구권, 기본권 보장을 위한 국가의 책무, 적법절차의 보장, 재판청구권, 인간답게 살 권리 등에 관한 법리들이 바로 그것이다. 도피성 제도에서 집약되고 있는 이러한 법리들의 사상적 요체를 단언적으로 말한다면 ‘생명권의 보호와 삶의 회복을 통한 인간존엄과 가치 확보’라고 할 수 있다. 도피성 제도에 내재된 인간존엄 사상은 인간이 하나님의 형상으로 지음을 받았다는 기독교적 인간관에 기초하고 있다. 법과 제도를 형성해 가는 인간이 절대적 진리에 대한 경외심을 지닌 가운데 타인을 존중하고 사랑해야 한다는 것과 함께 인간이성을 절대화시키는 오류에 빠져 인간 존엄성과 그 가치를 해치지 않도록 늘 스스로 경계하며 살아야 함을 도피성 제도를 통해 배울 수 있다.
영문 초록 The cities of refuge in Old Testament played an important role to prevent a false death from revenge so that it functioned as the criminal justice system for securing human rights such as the right to life and human dignity. Reviewing the system, we can find a couple of legal principles of fundamental rights that Korean Constitution has adopted; those of human dignity, right to pursue happiness, state's obligation to secure fundamental rights, due process of law, right of access to courts, and right to live dignified life. Briefly to say, the core objective of legal principles that were inherent in the system is primarily to ensure the right to life and secure the human dignity. The thought of human dignity embedded in the refugee system reflects the christian perspective that human beings were created after image of God. Additionally, we can get the lessons that a man who forms a law and a system must be awed by absolute truth and be cautious not to harm other person's dignity, without idolizing human rationality.
