| 국문 초록 | 일반적으로 법학적인 논의공간에서 사랑과 법의 연관성을 다루는 연구는 낯설게 생각되는 듯하다. 그러나 오랜 세월동안 법률가들이 붙잡고 씨름해온 문제들의 본질에는 사랑의 문제가 자리잡고 있다. 궁극적으로 법의 목적은 사회정의의 실현을 위해 봉사하는 것으로 이해될 수 있으며, 사랑은 그곳으로 인도하는 로드맵 역할을 한다. 사랑의 문제를 배제하고 추론과 분석에만 초점을 맞춤으로써 언제나 공정하거나 정당한 결과를 가져올 수 있는 것이 아니라는 점을 부인할 수는 없을 것이다. 법과 사랑의 융합, 인간이 고안해 낸 법과 법에 도전을 가하고 심지어 법을 바꾸어놓을 수 있는 영감의 결합이 필요하다. 법을 파생적인 규율, 즉 사랑으로부터 유래된 규율로 이해하면 법적 환경 전체에 걸쳐서 정의의 수준이 고양될 것이다. 법은 정의사회의 실현을 위한 도구이다. 법에 대해 사랑에 기반한 접근방식을 취한다면 우리 사회는 실질적으로 정의로운 사회에 한 걸음 더 다가갈 수 있을 것이다. 사랑으로부터 비롯된 법을 만드는 열쇄는 사랑의 에너지와 연결되어 있다. 이것은 개방적이고 동정심을 가진 관대한 마음이다. 사랑은 모든 사람에 대한 깊은 동정심과 건강한 삶에 대한 접근권의 부여를 요구한다. 이것은 많은 사람들이 건강을 유지할 수 없는 상태에 노출되는 것에 무관심할 수 없게 만들고, 지구상의 모든 사람에 대한 사랑과 동정의 마음은 지구환경을 기후변화의 충격에 무방비 상태로 방치하지는 않을 것이다. 그리하여 사랑으로 파생된 법에 의해 이웃사랑의 제도가 제자리를 잡게 될 것이다. |
| 영문 초록 | Jesus said. “Woe to you, teachers of the law and Pharisees, you hypocrites! You give a tenth of your spices--mint, dill and cummin. But you have neglected the more important matters of the law--justice, mercy and faithfulness. You should have practiced the latter, without neglecting the former. You blind guides! You strain out a gnat but swallow a camel.”(Mt.23:23-24) And He said, “‘Love the Lord your God with all your heart and with all your soul and with all your mind.’ This is the first and greatest commandment. And the second is like it: ‘Love your neighbor as yourself.’ All the Law and the Prophets hang on these two commandments.”(Mt.23:37-40) According to His teaching, the greatest commandment in the Law is Love. It''s not different in secular law. Love is the very foundation upon which laws should be based. The purpose of the law is to serve justice; and Love can serve as a road map to get us there. It is a powerful force that can generate laws consistent with the goals of justice and equality. Focusing on reason and analysis to the exclusion of Love results in laws that are not always just or fair. There is a need for a broader, more synoptic linkage of law with love. The connection between human-crafted law and inspirational forces that should challenge and, possibly, even transform or transcend law.” Viewing the law as a “derivative discipline,” a discipline derived from Love, will enhance justice throughout the legal landscape. The law is a tool for human justice. A Love-based approach to the law can provide a road map to lead us toward justice. We should not neglect love, the core value of law. Love and Law are inherent in many of the questions lawyers grapple with. |
