| 국문 초록 | 본 논문은 특허제도의 기원과 산업혁명기에 있어서 특허권의 역할 그리고 특허권의 국제화에이르기까지 특허제도의 변천을 알아보고, 오늘날 특허제도가 미치는 사회경제적 영향을 살펴본후에 공익적 관점에서 특허제도의 본질과 특허권의 존속기간에 대하여 살펴본다. 특허제도는 발명을 한 자에게 인센티브로 특허권을 부여함으로써 국가산업발전을 촉진하는데 그 목적이 있다고특허법에서 규명하고 있다. 그러나 특허제도가 그 목적의 범위를 일탈하여 특허권의 남용과 오용으로 인하여 장점보다 폐단이 더 크게 나타나고 있다. 필자는 특허제도를 하나의 경제행위로 보고 경제행위가 사랑에서 기인해야 한다고 하는 시각에서 본 논문을 시작하였다. 특허제도를 기독교적 시각으로 바라볼 때 특허제도로 인한 사회적·경제적 불균형을 해소할 수 있다고 본다. 전통적 경제학이 현대의 특허제도에도 그대로 투영되어 있으므로 특허제도에 있어서 규범적 요소들을 고려한 새로운 재조명과 접근이 필요하다고 하겠다. |
| 영문 초록 | The main purpose of this study is to develop an understanding ofchanges to patent rights and research the following three aspects:social economic effects of the patent system, essence of the patentsystem in a biblical economics respect, and the proper direction of thepatent system in the future. To recognize differences in the patent system, the origins of the patent system, the role of the industrial revolution and internationalization were analyzed. One of the most significant current discussions in moral philosophyis the negative effects of the patent system. In patent law, the aim ofthe patent system is defined as an incentive for an inventor topromote the development of a national industry. The patent system,however, departs from the scope of the purpose. The misusing andabusing of the patent system has produced negative effects for humanbeings rather than benefits. This paper regarded the patent system as an economic action andthat its activity should be based on love. From this perspective, God is necessary to resolve the problem of unbalance caused by the patent system in the social economics area. Thus, new approaches to analyzeand consider normative elements of the patent system are needed toresolve fundamental problems of the patent system |
