| 국문 초록 | 20세기 중반에 접어들어 세계 각국이 피해자 보호를 위한 일반원리들과 실천원리들을 정립하여 제시하고 있으나 아직 피해자 보호는 충분한 정도에 이르지 못하고 있다. 그것은 범죄피해자 보호를 위한 정책이 꾸준히 개발되고 법률ㆍ제도 또한 정비되어 가고 있지만 이를 운용하는 사람들이 범죄피해자 보호의 본질이라고 할 수 있는 헌법 제10조 인간존엄성 보장규정과 같은 일반원리에 담긴 기본정신을 충분히 숙지하고 있지 못하기 때문이다. 성경 누가복음 10장에 등장하는 선한 사마리아인의 비유는 강도를 당해 쓰러져 있는 피해자에 대하여 제사장과 레위인, 그리고 사마리아 사람이 어떻게 대응하는가를 보여주고 있다. 제사장과 레위인은 피해자에게 공식적 대응을 해야 하는 중요한 이웃임에도 초기대응에 실패하여 피해자의 생명을 위협하는 상황으로 몰고 갔지만, 사마리아 사람은 아무런 법적, 공동체 윤리적 보호책임이 없는 자임에도 초기대응을 성공적으로 함으로써 피해자의 생명을 구원하였다. 이 비유 속에 나타난 범죄피해자에 대한 보호의 본질은 ‘이웃사랑’이다. 이 이웃사랑의 법률적 표현이 바로 헌법 제10조 인간의 존엄성 보장이며 이것이 바로 피해자 보호에 있어서 핵심적인 일반원리인 것이다. 이를 기초로 다양한 실천원리 등을 추출할 수 있었고 이를 기반으로 범죄피해자 보호정책의 개선을 위한 시사점을 얻을 수 있었던바, 피해자에 대한 공감교육 강화, 범죄피해자에 대한 초기 대응태세의 확립, 범죄피해자의 기초적 생존확보를 위한 물질적 지원체계 구축 등과 같은 정책제안들이 바로 그것이다. |
| 영문 초록 | Since the mid 20th century, many countries have established general or practical principles for victim protection. However, the ways in which those principles are applied in victim protection are not sufficient nor effective for protecting victim rights. This is because people who enforce the relating laws do not fully understand the concept of the human dignity in the Constitutional Law, which is the essence of the victim protection. The parable of the good Samaritan in the Gospel of Luke teaches the right way of responding to a man robbed on the street. In contrast to the Priest and the Levite who put the victim into a life-threatening situation by neglecting him, the Samaritan responded as he thinks fit to the condition of the victim and rescued him. The parable teaches that the spirit of loving neighbor is the very essence of the crime victim protection. This very spirit is exactly expressed in legal terms in the Article 10 of the Constitution of South Korea. The legal terms expressed in the Article 10 understood this way secures human dignity as an important general principle. This author believes that various practical principles and suggestions can be drawn from that principle for improving the victim protection policies. |
