| 국문 초록 | 이 글에서는 칼뱅주의 기독교철학자인 도예베르트(Herman Dooyeweerd, 1894-1977)의 법사상을 살펴 보았다. 도예베르트는 “네덜란드 헌법에서의 내각”이라는 주제로 법학박사학위를 취득하였고, 『이론적 사고의 신비판』(A New Critique of Theoretical Thought) 및 『법학백과사전』(Encyclopedia of Science of Law) 등 다양한 법학연구성과를 남겼기 때문에 연구의 필요성이 존재한다. 이 글에서는 1) 법개념, 2) 자연법론과 법실증주의에 대한 관점, 3) 권리이론, 4) 사회이론과 국가이론으로 나누어서 도예베르트의 법사상을 살펴보았다. 1) 도예베르트는 “창조법”(creational law) 개념을 통해 하나님의 주권과 통일성을 강조하면서도 “법-양상”(juridical mode) 개념을 통해 다른 양상과 구분되는 법의 고유성과 다원성을 강조한다. 그리고 “법-양상”의 의미핵으로 “응보”(retribution)를 들고 있다. 2) 도예베르트는 자연법론과 상대적으로 친화성을 보이면서도 자연법론과 법실증주의의 한계를 모두 지적한다. 자연법론의 경우에는 자연법과 실정법이 동시에 법원(source of law)으로서 작동을 할 경우 불명확한 법률관계가 형성되는 문제가 있고, 법실증주의의 경우에는 역사적 형식 부여를 절대화하는 문제가 있기 때문이다. 도예베르트는 이 두 가지를 극복하기 위해 “법원리의 실정화”라는 대안을 제시하고 있다. 3) 도예베르트는 권리이론에서 주체와 객체를 균형 있게 보아야 한다는 점을 강조하고 있는데, 이는 주체를 중시하는 권리이론이 개인주의적인 권리이론으로 흐를 가능성이 있기 때문이다. 4) 그는 국가 또는 개인이 지나치게 지배적인 영향력을 행사하는 국가 및 사회이론을 배제하려고 노력하였는데 이러한 맥락에서 보충성의 원리(principle of subsidiarity), 사회계약론(social contract theory) 등에 대해서 비판적으로 본다. 이상과 같은 검토를 토대로 세 가지 질문에 대해서 답변을 해보면 다음과 같다. 첫째, 하나님의 주권을 강조하는 칼뱅주의 법사상의 특징이 무엇인가 하는 점이다. 도예베르트는 하나님과 인간의 경계로서의 창조법의 개념을 인정하고, 각 영역이 하나님의 주권에서 파생된 주권을 갖는다는 영역주권론을 받아들인다. 이러한 맥락에서 국가권력의 통제와 다원적인 사회관계가 강조된다. 또한 자연법론에 대해서 좀 더 친화성을 가지면서도, 원리의 실정화를 통해서 보다 안정적인 법질서를 추구한다. 둘째, 창조-타락-구속의 기독교적 동인에 입각한 법사상이 기존의 법사상과 차별화된 관점을 부여하는 측면이 무엇인가 하는 점이다. 도예베르트에 의하면 인간의 삶을 규정하는 다양한 양상들이 공존하는 것이 “창조”법에 부합하고 특정의 양상이 법-양상에 지배적인 영향을 미치는 것은 “타락”의 모습에 해당한다. 그리고 각 양상의 고유성을 유지하면서도 모든 양상을 관통하는 의미의 총체를 지향하는 것이 “구속”의 모습에 해당한다. 이처럼 창조-타락-구속의 틀은 현대법을 새로운 관점에서 비판적으로 보고 나아갈 방향을 새롭게 제시한다. 셋째, 칼뱅주의 법사상이 다원화된 현대사회에도 적실성을 갖는가 하는 점이다. 칼뱅주의는 다원화된 현대사회에 오히려 적실성을 가질 수 있다. 특히 다양한 사회관계를 규율하는 각 법들이 내적 구조 원리에 따라 서로 구분되면서도 엔캅시스적으로 서로 연결되어 있다는 점을 밝힘으로써 법의 다원성과 통일성을 함께 볼 수 있도록 하는 점, 권리이론에서 주체와 객체를 모두 강조하여 법에 있어서 개인주의와 전체주의를 비판적으로 볼 수 있도록 하는 점 등의 “균형감각”은 다양한 가치가 현존하는 현대사회에 오히려 적합한 측면이 있다. 또한 공법과 사법의 구별 및 상호보완적 관계를 설명하는 데에도 장점을 갖는다. 도예베르트의 법사상은 몇 가지 한계들도 존재하는데, 1) 법-양상의 의미핵으로 들고 있는 “응보” 개념이 지나치게 좁게 해석될 여지가 있다는 점, 2) 권리가 실정법에서 도출된다고 보고 있는 것은 강력한 인권이론을 구축하는 데에는 한계로 작동하게 된다는 점, 3) 사회계약론을 개인주의적인 이론으로만 보는 것은 타당하다고 보기 힘들다는 점, 4) 지방자치를 영역주권론의 적용범위에서 배제함으로써 지방자치 활성화에 한계가 있다는 점 등이 그것이다. 향후에는 이러한 한계를 보완한 좀 더 온전한 형태의 기독교 법철학을 구축하기 위한 시도가 이루어질 필요가 있다. |
| 영문 초록 | This article examines the legal thought of Herman Dooyeweerd(1894–1977), a Calvinist Christian philosopher. Dooyeweerd earned his doctorate in law with a dissertation on “The Cabinet in Dutch Constitutional Law”, and left behind a substantial body of legal scholarship, including “A New Critique of Theoretical Thought”, as well as “Encyclopedia of the Science of Law”. These works establish a clear need for scholarly examination. This article explores Dooyeweerd‘s legal thought under four headings: 1) the concept of law, 2) his views on natural law theory and legal positivism, 3) rights theory, and 4) social theory and state theory. 1) Through the concept of “creational law”, Dooyeweerd emphasizes God's sovereignty and the unity of creation, while through the concept of the “juridical mode”, he emphasizes the uniqueness and plurality of law as distinct from other modal aspects. He identifies “retribution” as the meaning-nucleus of “juridical mode.” 2) While showing relative affinity with natural law theory, Dooyeweerd points out limitations in both natural law theory and legal positivism. Natural law theory poses the problem that when natural law and positive law simultaneously function as sources of law, ambiguous legal relationships can arise; legal positivism, meanwhile, absolutizes the historical form-giving of law. To overcome both limitations, Dooyeweerd proposes the alternative of “the positivization of legal principles”. 3) In his rights theory, Dooyeweerd emphasizes the need to balance subject and object, since rights theories that overemphasize the subject risk devolving into individualistic conceptions of rights. 4) He sought to exclude theories of state and society in which either the state or the individual exercises excessively dominant influence, and in this context he critically examines the principle of subsidiarity and social contract theory. Based on the foregoing examination, three questions may be addressed as follows. First, what are the distinguishing features of Calvinist legal thought’s emphasis on sovereignty of God? Dooyeweerd affirms the concept of creational law as the boundary between God and humanity, and adopts the theory of sphere sovereignty, according to which each sphere possesses a sovereignty derived from sovereignty of God. In this context, the control of state power and pluralistic social relations are emphasized. Furthermore, while showing greater affinity with natural law theory, Dooyeweerd pursues a more stable legal order through the positivization of legal principles. Second, what distinctive perspective does legal thought based on Christian ground motive of creation-fall-redemption offer in contrast to existing legal thought? According to Dooyeweerd, the coexistence of the various modal aspects that govern human life accords with “creation”, while the domination of the juridical mode by any particular aspect corresponds to “fall”. “Redemption”, in turn, corresponds to the orientation toward a totality of meaning that runs through all modal aspects while preserving the uniqueness of each. In other words, the framework of creation-fall-redemption offers a critical vantage point on contemporary law and charts a new direction forward. Third, does Calvinist legal thought retain relevance for pluralistic contemporary society? Calvinism can indeed be highly relevant to pluralistic contemporary society. In particular, its “sense of balance” - demonstrated by showing that the various bodies of law governing diverse social relations are mutually distinguished according to their internal structural principles while nevertheless being encaptically interconnected, thereby allowing one to perceive both the plurality and unity of law together, and by emphasizing both subject and object in rights theory so as to critically assess both individualism and totalitarianism in law - proves especially well-suited to a contemporary society marked by the coexistence of diverse values. It also has the advantage of explaining the distinction between public law and private law, as well as their complementary relationship. Dooyeweerd‘s legal theory nevertheless has following limitations: 1) the concept of “retribution”, identified as the meaning-nucleus of the juridical mode, is susceptible to overly narrow interpretation; 2) grounding rights in positive law poses a limitation for constructing a robust theory of human rights; and 3) it is difficult to sustain the view that social contract theory should be regarded solely as an individualistic theory, 4) by excluding local autonomy from the scope of application of the theory of sphere sovereignty, his theory has a limitation in fostering the vitalization of local autonomy. Future scholarship should undertake efforts to construct a more complete form of Christian legal philosophy that addresses these limitations. |
