| 국문 초록 | 1948년 세계인권선언 이래 인권의 보편성과 인간의 존엄성 존중 정신의 확대 흐름, 공동체의 책임에 대한 성경적 관점 등에 비추어볼 때 보호책임은 기독교 정신에 부합하는 국제법적 원칙이라고 평가할 수 있다. 또한 보호책임 이론의 발전과 전개 과정을 살펴볼 때 북한에 급변사태가 발생하고 북한주민의 인권에 대한 극심한 침해상황이 발생할 경우에는 보호책임이론에 근거한 국제사회의 긴급한 개입이 정당화된다고 해석해야 할 것이며, 특히 남북한 특수관계론, 민족자결의 원칙 등을 종합적으로 고려할 때 남한이 북한주민들의 자유와 인권, 생명을 보호할 1차적인 권한과 책임이 있다고 해석해야 한다. 이러한 측면에서 최근 국제사회에서 논의되는 보호책임이론을 통일을 본격적으로 준비하는 차원에서 보다 적극적으로 받아들이고 이론적으로 발전시킬 필요가 있다. |
| 영문 초록 | Since the Universal Declaration of Human Rights of 1948, in the light of the growing trend of respecting the universality of human rights and human dignity, and the biblical perspective on the responsibility of international community, the ‘Responsibility to Protect’(R2P) is an international law principle which is consistent with Christianity. Additionally, having examined the development in the ‘Responsibility to Protect’ theory, when a sudden change and widespread and gross violation of human rights occurs in North Korea, an urgent intervention by the international community is justified in the basis on ‘Responsibility to Protect’ theory. Giving comprehensive consideration to the theory of ‘Special Relationship between South and North Korea’ and the principle of ‘Right of Self-determination of Peoples’, it would be safely said that South Korea is primarily charged with the protection of North Korean residents’ freedom, human rights and life. In this regard, in preparing for the unification of the Korean Peninsula, the ‘Responsibility to Protect’ theory is necessary to be widely accepted and developed in its theory. |
