| 국문 초록 | 전통적인 법률가의 이미지인 고용된 총잡이는 자신의 유일하고 첫째가 되는 의무는 수단과 방법을 가리지 않고 의뢰인을 위해 싸우는 것이라고 본다. 이러한 변호사 모델은 근래에는 람보식 법률가라는 신조어를 가져오기에 이르렀으며, 법조직에 대한 공공의 불신과 비판을 가져오고 있다. 그리스도인 법률가도 이러한 법률가 모델에 만족할 수 있을 것인가? 필자는 변호사, 특히 그리스도인 변호사가 복수의 도구로 전락하는 것을 거부하고, 성서의 가르침을 기반으로 하는 화해자와 치유자가 되어야 한다고 주장한다. 소송절차는 냉혹하게 복수심에 불타는 보복의 악순환으로 변질될 위험이 있고, 어느 누구도 진정한 만족을 얻을 수 없게 된다. 변호사는 악과의 비협조를 선언하고 폭력의 논리를 직시함으로써 폭력의 악순환의 고리를 끊는 자가 되어야 한다. 때로는 명목상의 승리가 실질적 패배가 되고 마는 이치를 지적해줄 수 있는 ‘고용된 비둘기’ 라고 하는 법률가 모델이 확립되어야 한다. 정의는 사랑에서 비로소 그 완성에 도달하게 되기 때문이다. |
| 영문 초록 | The image of lawyers as zealous advocates for their clients is imprinted in lawyers'' minds and reflected in the eyes of the public. If the image of a hired gun suggests a kind of unquestioning loyalty to the client, then the image of a Rambo lawyer represents one who maintains a kind of blind allegiance to the adversary system and its values. The image of the lawyer as hired gun or the lawyer as Rambo lawyer have to give way to the image of the lawyer as “hired dove”(peacemaker). Those who take seriously the teaching and example of Jesus are called to exceed the ethical standards of the legal profession, not to merely comply with them, to show agape love to their adversaries, and to be peacemakers. The meaning of the law is love. Therefore lawyer and his client have to live in such a way as to avoid lawsuits. In that image there is hope for real change and transformation. |
